RESOLUTION of the Research and Practice Conference "Modern approaches to the formation of legal basis of education"

In the general opinion of conference participants the draft integrated law submitted for public discussion is not sufficiently focused on the strategic development of education, mainly summarising the current educational practices according to the case basis. Therefore, the conference recommends elaborating and including in the national legal system of effective mechanisms to ensure sustainable development of education as one of the key social institutions that shape the conditions of designing of long-term horizons of state and society development, stimulate the growth of global competitiveness of Russian intellectual, technological and human resources. The conference participants declare that the formation of legal mechanisms that determine the basis and prospects of the national education system should be made subject to the following principles: 1. The principle of unity of educational environment, ensuring high quality of and equal access to education. 2. The principle of parity of education and upbringing. 3. The principle of integration of education and science. 4. The principle of academic freedom. 5. The principle of unity and continuity of levels of education ­ "education throughout life".


6. The principle of balance of the interests of students, teachers, employers and founders as the main participants of the educational process. 7. The principle of transparency and openness of education to society. These principles should be harmonized with legal mechanisms of all areas of law governing the sphere of education, because so far they are fragmented and do not represent systematic legal framework of education. Therefore, the adoption of the law under discussion should be accompanied by the elaboration of special regulations to be included in sector legislation (budget, tax and labor) in order to account for the peculiarities of legal regulation of educational activity. The participants of the research and practice conference agreed about the following: 1. To submit to the Government of the Russian Federation a proposal to continue broad public discussion of the draft federal law "On education in the Russian Federation". To form a special commission with the participation of leading representatives of university community, as well as the most respected lawyers in Russia for the purposes of public discussion coordination. 2. To recommend Russian Rectors' Union to include the issue of improving the legislative framework for education in the agenda of the ordinary Congress of Russian higher school rectors. 3. To submit to the Ministry of Education and Science the proposal to consider durin g its subsequent work with the draft the set of observations and recommendations from the Russian Rectors' Union and suggestions to improve the draft under discussion expressed in the report of the RRU President and the speeches of the conference participants.
